Here's how Tulfo wants to penalize employers that don't release 13th month pay
For Senator Raffy Tulfo, the best way to penalize employers that fail to release the 13th month pay of their employees is to prevent them from renewing their business permits.

Tulfo made this suggestion to the Department of Labor and Employment (DOLE) during a joint Senate hearing between the Committees on Labor, Employment, and Human Resources Development; Social Justice, Welfare, and Rural Development; and Finance on Tuesday, Oct. 4.
“This is the time of the year na kung saan ang ating manggagawa inaasahan, pinapangarap, sila po ay makakatanggap ng kanilang (when our workers hope to receive their) 13th month pay. Kadalasan po, hindi nabibigay sa manggagawa natin ang 13th month pay. Ginugulang sila, dinudugasan ng mga (Oftentimes, they do not receive their 13th month pay. They are taken advantage of by their employer),” Tulfo began.
“This is your first December as the Asec (Assistant Secretary) of the DOLE, this is my first December bilang (as a) Senator, ano po ang pwede ninyong magawa (what can you do about this)?” Tulfo asked DOLE Legislative Liaison and Legal Affairs Cluster Assistant Secretary Lennard Serrano
Serrano told the panel that the DOLE issues “labor advisories” that tell employers when they are required to give their workers 13th month pay.
“Ganito na lang po, mag-issue kayo ng warning sa lahat ng employer (How about this, issue a warning to all employers): There will be dire consequences kapag hindi binigay yung (if you do not release the)13th month pay on time this year 2022,” Tulfo pitched.
To put some teeth on his suggestion, Tulfo wants the DOLE to enter a memorandum of agreement (MOA) with local government units (LGUs), their respective mayor’s offices, and the business permit and licensing offices.
“Kapag yung employer, mag-renew ng kanyang permit, kailangan niyang magpakita ng ebidensya na nakapag-bayad po sya ng (If an employer wants to renew their permit, they need to show evidence that they’ve released the) 13th month pay sa lahat ng kanyang empleyado (to all their employees). Failure to do so hindi po ma-renew ang (means that they cannot renew their) permit,” the senator said.
Serrano said they would work with other agencies to implement Tulfo’s suggestion. But for now, DOLE would act through the aforementioned labor advisories.
Unsatisfied with the response, Tulfo said that “yung advisory na yan, balewala lang yan sa (those advisories are nothing to) employers.”
