Only employees who would be reporting to work during the long weekend holiday would get extra pay, the Department of Labor and Employment (DOLE) announced on Saturday, Oct. 29.
In his Labor Advisory No. 21, Series of 2022, DOLE Secretary Bienvenido Laguesma said that ’no work, no pay’ policy will be in effect this year's special non-working days on Oct. 31, observation of All Saints’ Day (November 1) and All Souls’ Day (November 2).
The LA No. 21-22 was signed by Laguesma on Friday, Oct. 28.
Laguesma said the labor advisory is in pursuant to Proclamation No. 79 issued by President Ferdinand Marcos, Jr. on Oct. 18 this year along with Proclamation No. 1236 by former president Rodrigo Duterte on Oct. 29, 2021.
It stated that no pay principle applies for Oct. 31 and Nov. 2 unless there is a favorable company policy, practice, or Collective Bargaining Agreement (CBA) granting payment on a special holiday.
However, employees who would work would be entitled to get an additional 30 percent of their basic wage.
“For work done during the special day that also falls on his/her rest day, he/she shall be paid additional 50% of his/her basic wage on the first eight hour of work (Basic wage x 150%),“ the advisory read.
On Nov. 2, declared as a special working day, no premium pay is required since work performed on that day is considered work on an ordinary working day.
“For work performed on a declared Special Working Day, an employee is entitled only to his/her daily wage. No Premium pay is required since work performed on said day is considered work on an ordinary working day,” it added.
Meanwhile, the regular holiday on Nov. 2 adjusted salary computation should apply to all employees.
For employees who would not report for work, they are entitled to get their basic wage x 100 percent, while employees who would work would receive double of their daily salary.
