Comelec orders parties to submit memoranda on Marcos DQ case within 48 hours

The Commission on Elections (Comelec) First Division ordered on Friday, Jan. 7, the petitioners as well as the camp of the respondent Ferdinand “Bongbong” Marcos Jr. to submit their respective memoranda within 48 hours in connection to the disqualification case filed against the presidential aspirant.

The preliminary conference was aired live on Facebook for the first time, and was presided by Comelec Commissioner Rowena Guanzon. An hour-long delay in the proceedings occurred as the first division asked for a copy of the medical certificate of Marcos Jr. who according to his legal counsel, Atty. Hanna Barcena was not feeling well and was not present during the proceedings.
Marcos Jr. was said to be in isolation after being exposed to two individuals who were positive for coronavirus disease (COVID-19)
It was unclear why the first division wanted the physical or the virtual presence of the respondent as Comelec spokesman James Jimenez stated that the presence of legal counsels would be sufficient. The respondent's legal counsel also asserted that the summons issued indicated that the lawyers are allowed to represent.
A medical certificate was later presented, stating that Marcos Jr. had a temperature of 37.8 degrees Celsius and was having a sore throat.
Disqualification cases
Three disqualification cases were raffled off to the Comelec First Division which were filed by Bonifacio Ilagan, Abubakar Mangelen and Akbayan.
Abubakar Mangelen's disqualification case was deemed submitted for resolution according to Guanzon as both the petitioner nor his lawyers were not present during the proceedings. Mangelen filed on Dec.2 as well a petition seeking the declaration of nullity of Marcos' Certificate of Nomination and Acceptance (CONA). He said that he was the duly elected chairman of the Partido Federal ng Pilipinas (PFP) where Marcos Jr. is the standard bearer.
His disqualification case against Marcos Jr. was filed on ground of ineligibility arising from a previous conviction of a crime involving moral turpitude.
On the other hand, Atty. Antonio Salvador stood as the legal counsel of Akbayan who filed on Dec. 2 a disqualification case against Marcos Jr. and averred that Marcos Jr. is "perpetually" barred from running for public office due to his 1995 tax evasion conviction. The respondents also stated that Marcos Jr. was convicted of crimes involving moral turpitude and was sentenced to a penalty of imprisonment of more than 18 months.
Their petition was signed by Akbayan's First Nominee Percival Cendaña, former Commission on Human Rights (CHR) Chairperson Etta Rosales, Akbayan Youth Chairperson Dr. RJ Naguit, women leader Jean Enriquez of the Coalition Against Trafficking in Women (CATW-Asia Pacific), and labor leader Nice Coronacion of the Sentro ng Nagkakaisa at Progresibong Manggagawa (SENTRO).
The very first disqualification case against Marcos Jr. was filed on Nov. 17, 2021 by Bonifacio Ilagan et al. They were represented by Atty. Jake Rey Fajardo who also raised similar points as Akbayan.
The petitioners stated as well that they have secured a certification from the Quezon City Regional Trial Court Branch 105 on Dec. 2, 2021 that there has been no compliance of payment or satisfaction of the decision of the RTC dated July 27, 1995 or the Court of Appeals dated Oct. 31, 1997 but Barcena said that it has been paid for "a long time ago" on Dec. 27, 2001. Guanzon then required Marco's camp to attach the Original Receipt (OR) to prove that it was paid for in the Bureau of Internal Revenue (BIR).
Deadline for the submission of their respective memoranda was set on Sunday, Jan. 9 at noon via email while hard copies are to be submitted by Monday, Jan. 10.
