Plus 30% wage awaits workers on Chinese New Year, People Power Anniversary


Employees who will report to work on special non-working days of Feb. 1, which was is Chinese New Year, and on Feb. 25, which is the EDSA People Power Revolution Anniversary, will get full-pay plus 30 percent of their basic wages.

Labor Secretary Silvestre Bello III reminded employers to observe the proper payment of wages on these dates which were declared as Special (Non-Working) Day.

Bello issued last week Labor Advisory No. 3, Series of 2022 to guide both employers and employees on the proper computation of premium pay for these special non-working days.

Premium pay, according to Bello, refers to the additional compensation for work performed within eight hours on non-workdays, such as special days.

Under the Labor Advisory, employees who will report for work on the said days should be paid an additional 30 percent of their basic wage on the first eight hours of work. Their basic wage should be multiplied by 130 percent plus COLA.

Meanwhile, employees who will render overtime work should be paid an additional 30 percent of their hourly rate on the said day.

Thus, the compensation will be "hourly rate of the basic wage x 130 percent x 130 percent x number of hours worked."

Also stated in the advisory is that those who will render work on a special day that also falls on their rest day shall be paid an additional 50 percent of their basic wage on the first eight hours of work. The computation is .

Employees who will work overtime during a special day that also falls on their rest day shall be paid an additional 30 percent of their hourly rate on the said day. This is computed as the hourly rate of the basic wage x 150 percent x 130 percent x number of hours worked.

However, for employees who did not work, the "no work, no pay" principle should be applied unless there is a "favorable company policy, practice, or collective bargaining agreement granting payment on a special day."

February 1 and February 25 are declared Special (Non-Working) Days under Presidential Proclamation No. 1236 issued by President Duterte on October 29, 2021.
