Manila LGU suspends NCAP implementation following SC TRO

Manila Mayor Honey Lacuna-Pangan ordered on Wednesday, Aug, 31, the suspension of the implementation of the No Contact Apprehension Policy (NCAP) in the city following the Supreme Court’s issuance of a temporary restraining order (TRO) on Tuesday, Aug. 30.

“Gayung naihain ang petisyon laban sa NCAP sa Korte Suprema at inutos ang pansamantalang pagtigil sa implementasyon ng NCAP, susundin po ng Lungsod ng Maynila ang Temporary Restraining Order sa oras na natanggap po ito (As the petition against the NCAP was filed in the Supreme Court and ordered the temporary suspension of the implementation of the NCAP, the City of Manila will comply with the Temporary Restraining Order as soon as we receive it),” Lawyer Princess Abante, City of Manila communications head, said in a separate statement on Tuesday, Aug. 30.

“Batay sa mga petisyon na sinampa sa Korte Suprema, sinasabi nitong may mga pagkukulang at problema ang NCAP. Nararapat lamang na pag-aralang mabuti sa korte ang mga naturang mga puna at sinasabing mga problema sa NCAP ng gayo'y mabigyan ito ng resolusyon (Based on the petitions filed in the Supreme Court, it says that NCAP has shortcomings and problems. Such comments and alleged problems in NCAP should only be carefully studied in court so that it can be resolved),” it added.

While the city assured that it will abide by the TRO on NCAP, Abante still pointed out the benefits it brought to the city.

Through the NCAP implementation, she said traffic violations and road accidents in the city were reduced by half.

Extortions were also eliminated, traffic flow was smoother, and roads have become safer, not only for vehicles but also for pedestrians and cyclists, Abante added.


The city government also highlighted the importance of advancement of technology to achieve development in Manila.

“Naniniwala ang liderato ng Pamahalaan ng Lungsod ng Maynila na ang tama't wastong pag-gamit ng makabagong teknolohiya ang siyang daan upang makapagdulot ng mabilis, episyente, at maginhawang serbisyo sa lahat ng mamamayan (The leadership of the City of Manila government believes that the right and proper use of modern technology is the way to bring fast, efficient, and convenient services to all citizens),” it added.

The city government, meanwhile, assured the public that its office is always open to receive any complaints as well as on the NCAP, adding the system also has an adjudication board where the motorist can contest the Notice of Violation.


The NCAP was implemented based on Section 16 of the Local Government Code and Ordinance No. 8092 or the Traffic Code of the City of Manila.

It was also strengthened by other ordinances issued by the Manila City Council, specifically Ordinance No. 8676 or "An Ordinance Implementing the No Contact Apprehension Program (NCAP) of the City Amending for the Purpose Certain Sections of City Ordinance No. 8092 and Ordinance No. 8327 and for other Purpose" that was issued September last year.

“According to the MMDA’s (Metropolitan Manila Development Authority) road safety MMARAS (Metro Manila Reporting and Analysis System) 2021 Annual Report, there were 1,950 fatal and non-fatal injuries recorded in the City of Manila in 2019. These injuries were reduced in 2021 to 1,033 -- lower by 917 injuries or by 47 percent,” Abante said.


In 2019, the Manila Police District recorded 11,093 road accidents in the city.
 This figure drastically dropped in 2021 to 4,206 which is a 62 percent decline, she noted.


 In June 2022, the recorded daily violations dropped significantly by 90 percent, or just four violations from the thirty-seven average daily violations per camera in February 2021.
