2 importers face smuggling raps over cigarette, hazardous chemicals shipments

Two importers are now facing smuggling complaints for allegedly misdeclaring their shipments of cigarettes and hazardous chemicals in the country in June 2021, the Bureau of Customs disclosed.

The BOC, through the Bureau's Action Team Against Smugglers (BATAS), has filed two criminal complaints before the Department of Justice (DOJ) against Goldlink Int'l Subic Inc. for the alleged misdeclaration and unlawful importation of over P111 million worth of counterfeit cigarettes that came in separate occasions on June 20 and 23 at the Port of Subic.

The bureau stressed that unlawful importation of counterfeit cigarettes is a violation of Republic Act No. 10863, otherwise known as the Customs Modernization and Tariff Act (CMTA) in relation to Customs Memorandum Order No. 20-2006; Tax Reform Acceleration and Inclusion Law; National Tobacco Administration (NTA) Board Resolution 079-2005; National Tobacco Memorandum Circular No. 03, s. 2004; and the Intellectual Property Code of the Philippines.

Lion King Industrial Corporation is also facing a criminal complaint for the alleged misdeclaration and unlawful importation of hazardous chemicals worth P3.8 million on June 9, 2021 through the Manila International Container Port.

According to BATAS, the importer violated pertinent provisions of the CMTA in relation to Republic Act No. 6969, otherwise known as An Act To Control Toxic Substances And Hazardous And Nuclear Wastes, Providing Penalties For Violations Thereof, And For Other Purposes (“R.A. 6969”), as implemented by Department of Environment and Natural Resources (DENR) Administrative Order No. 1992-29; Implementing Rules and Regulations of Republic Act 6969; and DAO No. 2013-24, Chemical Control Order (CCO) for Lead and Lead Compounds.

"To date, 73 criminal cases have already been filed before the DOJ against 237 individuals and customs brokers," the bureau said Thursday, Sept. 30.
