Solon says Constitution allows Duterte to seek VP post in 2022

Ako Bicol Party List Representative Alfredo Garbin, Jr. on Wednesday, June 2, expressed his belief President Duterte is allowed to seek the vice presidency in the May, 2022 elections.

Garbin, chairman of the House Committee on Constitutional Amendments, says the Constitution does not prohibit the incumbent Chief Executive to run for another top government position in next year’s polls.

“There is no prohibition and it is Constitutionally allowed, so he can run for vice president,” Garbin said in the Ugnayan sa Batasan online press forum.

“As to its acceptability or viability bahala na ho yung taombayan (It’s up to the people to decide),” he stressed.

“Pero wala pa naman ho siyang desisyon. Fino-float pa lang ho yun (But he has no decision yet. That is just being floated),” he pointed out.

“But there’s no constitutional prohibition. Therefore, he’s allowed to run as vice president,” he stressed.

In a press conference on Tuesday, June 1, Senator Richard Gordon said the Constitution prohibits Duterte from seeking another elective post after he steps down as President.

“If you look at the Constitution, it’s clear that the President has only one term, and he cannot run for any reelection,” Gordon said.

“’Any’ means, not as president, not as vice president and for that matter any other position,” the senator said adding that he expects intense debates on the matter should the President push through with this plan.

Garbin, however, countered Gordon, saying the 1987 Constitution only prohibited an incumbent elected official to seek the same position in the next polls.

“Re-election po hindi pwede. Pero hindi naman po sya tatakbong presidente ulit (He can’t seek re-election. But he’s not running for president again),” Garbin insisted.

“Yung VP pwede ho di ba? (Running for vice president is allowed right?) Because when you speak of re-election, (it pertains to) the same position. Iba naman ho yung position ng pagka bise presidente (The position of vice president is different),” he pointed out.
