Guidelines on arrest of protocol violators out on May 31 -- DILG exec

The guidelines for the arrest of violators of COVID-19 protocols are expected to be released on May 31, an official of the Department of the Interior and Local Government (DILG) said Saturday, May 29.

DILG Undersecretary and Spokesperson Jonathan Malaya said the Department of Justice (DOJ) has already signed the guidelines that will elaborate the do's and don'ts in the arrest of individuals who are not wearing face masks or those who are incorrectly wearing them while in public places.
Meanwhile, the guidelines are now only awaiting the signatures of DILG Sec. Eduardo Año and Philippine National Police (PNP) Chief Gen. Guillermo Eleazar.
“I would expect na sa Lunes tapos na ang legal review at puwede na i-anunsiyo na aprubado na ng bawat panig (I would expect that on Monday, the legal review will be completed and it can already be announced and approved by the concerned agencies),’’ Malaya said in an interview over Dobol B TV of GMA News.
Malaya added that the regulations will immediately be enforced after Año signs the COVID-19 safety measure guidelines.
The DILG official also assured that the guidelines will never run contrary to the ordinances of the local government units (LGUs).
“What I can say now is hindi babangga sa local ordinances at hindi taliwas doon kasi alam natin since the beginning hinikayat natin ang mga LGUs magpasa ng ordinance even the curfew (What I can say now is that this will not go against the local ordinances since we already know in the beginning that we urged the LGUs to pass the ordinances, even for the curfew),’’ Malaya added.
To prevent COVID-19 transmission, President Duterte directed the PNP to probe and detain for nine hours individuals who are not wearing face masks or have them improperly worn.
With the arrest of face mask violators, many individuals were apprehensive that this may lead to human rights violations, including tricycle driver Popoy Hidalgo.
“Ang mga face mask violation na pag aresto ay maaring magbigay daan sa mga tiwaling pulis na makapanakit ng pisikal ng legal sa mga violators. Minsan ang mga taong tulad ko na nasa kalye para maghanapbuhay bilang tricycle driver ay saglit na nagbaba ng face mask para makahinga (These arrests on face mask violation may give way for rogue police officers to legally administer physical pain on the violators. Sometimes people like me who are out on the streets earning a living as a tricycle driver may momentarily bring my face mask down to breathe),’’ Hidalgo said.
But Hidalgo agreed that stubborn individuals should be arrested for being a threat to public safety.
“Ibang usapan naman kung 'yong mga siga ay talagang nananadya na suwayin ang patakarang pangkalusugan ng pamahalaan. Dapat lang na mabulok sila sa kulungan at baka sakali magtanda na sila (It is another thing when the toughies intentionally disregard the health protocols of the government. They should languish in jail and hopefully they will learn their lesson),’’ he added.
