Many gov't agencies remain non-compliant to Citizen's Charter

The Anti-Red Tape Authority (ARTA) has released the names of government agencies, local government units, and other institutions that failed to submit their Citizen’s Charter, a list of requirements when transacting a business to minimize red tape in government and improve the ease of doing business in the country.

ARTA released the list on Friday, Dec. 31 via Department Order No. 2021-94 as mandated by Republic Act No. 11032 or the Ease of Doing Business and Efficient Government Service Delivery Act of 2018.

According to ARTA, the list of non –complaint agencies include agencies include Fourteen national government agencies, 573 local government units (LGUs), and 27 government owned and controlled corporations, 571 water districts, 13 state universities and colleges and one hospital.

Of the 573 LGUs, ARTA said that 31 are from the Cordillera Administrative Region ( CAR ); 10 from Region I; 10 from Region II; 20 from Region III; 19 from Region IV-A; 34 from Region IV-B; 26 from Region V; 26 from Region VI; 70 from Region VII; 60 from Region VIII; 47 from Region IX; 27 from Region X; 28 from Region XI; 26 from Region XII; 29 from Region XIII; and 110 from the Autonomous Region in Muslim Mindanao (ARMM).

Those included in the list are given until 6 January 2022 to submit their Citizen's Charter and Certificate of Compliance to the Authority at [email protected].

The publication of the list serves as ARTA's final warning to non-compliant agencies. Should they fail to submit the said requirements on the given date, the Authority will proceed with the filing of cases against them for violation of Republic Act No. 7160 as amended, R.A. No. 3019, as amended, R.A. No. 11032, or other applicable laws.

Those that do not have any revision in their previously submitted Citizen's Charter are only required to submit their Certificate of Compliance. Meanwhile, those that updated and revised their Citizen's Charter must submit it with the corresponding Certificate of Compliance.

The Citizen's Charter is an information billboard containing all pertinent information on the services that government offices provide. This includes the list of requirements, costs, and processing time for each service. All government agencies are mandated to put up their Citizen's Charters in prominent places in their offices.

The publication of the list of non-compliant government agencies was done following the release of the Office of the President's Memorandum Order No. 57 or "Directing the Submission of a Citizen's Charter and Compliance with the Automation of Business Permitting ad Licensing System."

The order stated that government agencies must submit their updated Citizen's Charters with the corresponding Certificate of Compliance to the Authority within 15 working days of its effectivity, which was on 24 November 2021.

As of 17 December 2021, ARTA's Compliance, Monitoring, and Evaluation Office (CMEO) received a total of 8,974 Citizen's Charter and Certificate of Compliance submissions from various government agencies.
