A petition-in-intervention has been filed before the Commission on Elections (Comelec) on Monday seeking to supplement an earlier petition to cancel the certificate of candidacy (COC) of presidential aspirant Ferdinand Marcos Jr. in the May 2022 polls.

The petitioners-intervenors are Edwin Reyes, Napoleon Siongco, Fernando Guevara, Rommel Bautista, Santiago Muńoa Jr, Glenn Gallos, Noel Carpio, Joel Mayo, Marie Soriano, and Mario Montejo.
The petitioners-intervenors said they have legal interest in the matter as they are citizens and registered voters who are invoking the Comelec’s mandate to dutifully enforce election laws.
In their motion filed on Nov. 8, the petitioners-intervenors said respondent Marcos Jr. was found guilty beyond reasonable doubt of violating Sections 45 and 50 of the National Internal Revenue Code and perpetually disqualified from holding any public office, to vote and to participate in any election.
“He was charged with four counts of violating Section 45 of the old NIRC for failing to file income tax returns, and similar four counts of violating Section 50 of the old NIRC for failure to pay alleged deficiency taxes,” they said.
They said the respondent made false material representation in his certificate of candidacy, particularly in part 22 of the COC when he unqualifiedly stated that he has allegedly not been found liable for an offense which carries with it the accessory penalty of perpetual disqualification to hold public office, which has become final and executory.
“Despite full knowledge of his disqualification, having been convicted of a crime penalized with perpetual disqualification from holding public office under the NIRC, respondent would continue with his deceitful and lying ways, maliciously and falsely representing in his certificate of candidacy that he is eligible to be elected as President of the Philippines and that he has supposedly never been found liable for any offense, which carries the accessory penalty of perpetual disqualification to hold public office,” read their motion.
The said material misrepresentation, the petitioners-intervenors said, is more than sufficient ground for the Honorable Commission to cancel respondent convicted candidate Marcos Jr.’s COC, or to deny due course to the same.
“Wherefore, it is respectfully prayed that Honorable Commission cancel outright the certificate of candidacy for president filed by Ferdinand Romualdez Marcos Jr. in connection with the 2022 National Elections for suffering perpetual disqualification from public office or that said certificate of candidacy be denied due course,” they said.
Last week, several groups and personalities submitted a petition with the poll body seeking to cancel or deny the COC of the former senator over supposed "false material representation" stemming from a 1995 tax case.
