Sandiganbayan accepts evidence of 3 accused in P18-M PDAF case

Despite the opposition of government prosecutors, the Sandiganbayan accepted most of the pieces of evidence submitted by three accused in the reported misuse of former Surigao del Sur Rep. Peter Paul Jed Falcon's P18.93 million in Priority Development Assistance Fund (PDAF) in 2007.
"The objection of the prosecution as to the relevance and purpose for which the exhibits are offered refer more to the probative value rather than the admissibility of the exhibits,” the Sandiganbayan said in a resolution.
It stressed: “The purpose of the offer and the objection in each of the exhibits shall only be evaluated in the ultimate disposition of the case."
With the ruling, the anti-graft court accepted the evidence offered in their cases by former members of Lingig town’s bids and awards committee (BAC) Teofilo Catig Maymay, Aludia De Castro, and Carmelo Rebosura.
They were charged with violations of the Anti-Graft and Corrupt Practices Act for reportedly conspiring with Falcon in purchasing various communications equipment worth P18,928,571.43 from Philflex Trading and General Merchandise without public bidding.
The prosecution also alleged that the various equipment were delivered to Falcon, who, despite receipt, failed to turn these over to the municipality of Lingig.
Most of those documents offered in evidence were admitted by the Sandiganbayan except those which were “mere photocopies."
The court said that under the Original Documents Rule, the use of photocopies is deemed inadmissible.
The court’s resolution was written by seventh division Chairperson Ma. Theresa Dolores C. Gomez-Estoesta with the concurrence of Associate Justices Zaldy V. Trespeses and Georgina D. Hidalgo.
