The criminal complaints were submitted to the Department of Justice (DOJ) for review before filing the same to the Court of Tax Appeals (CTA).

Eight of the accused, all based in Makati City, were identified as Philab Industries of San Antonio Village, Simpao Automotive Parts and Services of Bangkal, Envent 2 of Palanan Village, Adformatix of Legaspi Village, Onecom Resources of Poblacion, Hans Food of Guadalupe, Gold Barrel Social Club Resort Capital of Ayala Avenue, and FCB Manila of Ayala Avenue.

Makati Revenue Regional Director Maridur Rosario said the charges were filed after the responsible officers of the said companies ignored assessment and collection notices.

Likewise, the BIR legal service also filed the same case against GB Bem Cigarette Company of Angeles City for alleged non-registration, thus evading payment of some P154 million in income and excise taxes.

BIR and National Bureau of Investigation operatives confiscated illicit materials used in the manufacture of cigarettes when they raided the factory compound, like cigarette packing machine and rolls of cigarette paper.
