The Sandiganbayan Fifth Division is asking information technology expert Dexter Laggui, the witness of former Senator Jose "Jinggoy" Estrada in his plunder case, to produce more information before he can be deemed as an "expert witness."

Estrada, Napoles, his Deputy Chief of Staff Pauline Therese Mary C. Labayen, and John Raymund De Asis were slapped with a violation of Section 2 of R.A. 7080, otherwise known as plunder, because they reportedly pocketed P183,793,750 from Estrada's priority development assistance fund (PDAF) by endorsing Napoles' fake non-government organizations (NGOs) back in 2004.
During the trial held on Monday morning, Fifth Division Chairperson Rafael Lagos said they are holding off declaring Laggui as an expert witness since they are still waiting for the complete submission of his documents.
"You show your documents," Lagos told him, adding that he should likewise provide the anti-graft court with documents that would prove his expertise such as his EnCase Computer Forensic 2 certification.
At the same time, the court is asking for more proof that Laggui helped create the manual of the Department of Justice (DOJ) on cybercrime.
This directive came after Laggui told the Sandiganbayan justices that he was recently declared as an expert witness by a Makati regional trial court. Lagos also tasked defense lawyer Noel Malaya to submit to them the transcript of stenographic notes of the lower court.
By making Laggui an expert witness, he would be able to counter the statements made by prosecution witness Dario Sabilano, a special investigator of the National Bureau of Investigation (NBI).
Sabilano has been asked by the prosecution to testify on the integrity of the computer files found in the hard drive of priority development assistance fund (PDAF) scam whistleblower Benhur Luy, who was previously an employee of Napoles.
