BOC issues summary abandonment proceedings on cargo unclaimed amid ECQ

The Bureau of Customs (BOC) on Monday released summary abandonment proceedings on cargo unclaimed during the enhanced community quarantine (ECQ).

Customs Memorandum Order (CMO) No. 10-2020 was issued to effectively implement Joint Administrative Order (JAO) No. 20-01 or the Adoption of Processes for the Expedited Release of Refrigerated Containers and Dry Vans During the Period of Enhanced Community Quarantine.
The CMO states that cargoes at the terminal will be deemed abandoned when they remain unclaimed after three days from the seven-day or five-day withdrawal period, for refrigerated containers and chilled cargoes respectively, set under JAO No. 20-01.
Cargoes beyond 30 days from the date of discharge that are not withdrawn after five days of issuance will also be branded abandoned.
Goods subject to customs clearance that fail to comply with the set period to lodge goods declaration, pay duties and taxes, and claim the goods, shall also result to abandonment, the order read.
Meanwhile, reefer containers where no goods declaration has been lodged and those arriving after the issuance of JAO No. 20-01 that are not withdrawn within the set period shall be deemed abandoned.
With this, a Decree of Abandonment will be issued subject to the institution of summary proceedings for their immediate disposition.
According to the CMO, within 24 hours of the issuance of the Notice of Abandonment, the importer or consignee may request for the untagging of abandonment to be resolved by the District Collector within 24 hours from the receipt of the request.
The bureau shall then determine the proper disposition of refrigerated containers within 24 hours from the finality of the Decree of Abandonment.
Earlier, International Container Terminal Services, Inc. (ICTSI) executive vice president Christian Gonzalez said there is still a “significant amount” of unclaimed cargo at the Manila International Container Terminal (MICT) from before March 2020.
He said efforts should continue to ensure that the “dangerously low level of pullouts” that they experienced in March and April will not happen again.
On Monday, Gonzalez said operational levels at the MICT have returned to normal levels after cargo pullouts amid the ECQ peaked last week, and containers of unclaimed cargo were moved to other yards by the BOC and Philippine Ports Authority.
