Tax court orders contractor to pay BIR P198 M, sentences him to 15 years

By Jun Ramirez  The Court of Tax Appeals (CTA) has sentenced up to 15 years a housing and building contractor who is at large for massive under-declaration of earnings. Court of tax Appeals (MANILA BULLETIN) Court of tax Appeals (MANILA BULLETIN)  The court's Second Division also ordered Rommel Salva Ynion, owner of Hoksing Builders of Paranaque, to pay the Bureau of Internal Revenue (BIR) P198 million in income tax,   value-added tax (VAT) and delinquency interests. The court found Ynion guilty beyond reasonable doubt of under declaring his income for the years 2006, 2008 and 2010 by 24 to 175 percent. The court also gave credence to the testimonies of tax fraud investigators that the contractor deliberately missed in filing the quarterly VAT returns. Ynion did not contest the deficiency tax assessments, saying  he was not knowledgeable about accounting and taxation, entrusting the matters to his accountant. In a 58-page resolution penned by Associate Justice Jean Marie Bacorro-Villena, the court said Ynion has a masteral degree in shipping management and owns other businesses, so that it is unthinkable that he does not know his financial obligations to the government. Besides, it said that as a single proprietor he could not overlook the cash inflow and the tax remittances. Tax fraud investigation showed that the businessman acquired properties and other assets beyond his declared income.
