DOLE stops construction project following death of worker

The Department of Labor and Employment National Capital Region has issued a work stoppage order against a construction project of Momentum Construction and Development Corporation in Sampaloc, Manila following an accident which reportedly led to the death of a worker.

"Wherefore, premises considered, the Momentum Construction and Development Corp. and or Mr. Juan Dy, Sr. and those involved subcontractors, if any, are directed to immediately stop construction activity in the entire construction site at the said project site," read the order signed by Atty. Sarah Mirasol, DOLE NCR Director.
According to DOLE, the reported accident involving the death of one worker happened on July 14, 2019 at the Momentum Construction and Development Corp. project located at Piy Margal St. corner Dos Castillas St.
The incident, DOLE said showed the existence of grave and imminent danger to the health and safety of workers.
"On July 14, 2019, Labor Inspection Auditors, Mr. Mark Avner P. Acosta and Engr. Lory Fe Gutib conducted an Occupational Safety and Health Standards Investigation. During the interview with the Safety Officer of Momentum Construction, the victim was identified as Mr. Jhon Erick Marcoso, a steelman from a subcontractor engaged with Momentum Construction," the order read.
DOLE said the victim was hit by a fallen detached part of the crane causing his immediate death based on initial investigation.
Labor Inspection Auditors of DOLE also noted the following findings such as no occupational safety and health program; no first aiders; an inadequate number of safety officers; no safety health nurse among others.
To note, Article 128 of the Labor Code provides that "the Secretary of Labor may likewise order stoppage of work or suspension of operations of any unit or department of an establishment when non-compliance with the law or implementing rules and regulation poses a grave and imminent danger to the health and safety of workers in the workplace. Within 24 hours, a hearing shall be conducted to determine whether an order for the suspension of operations shall be lifted or not. In case the violation is attributed to the fault of the employer, he shall pay the employees concerned their salaries or wages during the period of such stoppage of work or suspension of operation."
The representatives of the aforementioned establishment and sub-contractors were invited to attend a hearing on July 16 at the DOLE NCR Bldg in Malate, Manila to determine the propriety of having the Work Stoppage Order lifted or not.
"The Technical Services and Support Division Regulatory personnel and or sheriffs are directed to immediately serve and implement this order. Failure to comply with this order is a criminal offense punishable under Article 288 of the Labor Code of the Philippines," it read.
