Additional P710 in minimum wage up to Congress - Bello

However, approving it is not under the authority of the Department of Labor and Employment (DOLE), not even the President. It’s under the mandate of the Congress. They will have to legislate,” Bello said. On Monday, the TUCP filed a petition before the National Capital Region Tripartite Wages and Productivity Board (NCR- RTWP) seeking to increase daily minimum wage from P537 to P1,247. Bello said DOLE will also provide its input if Congress should decide to have a minimum wage in the country instead of having a different minimum wage for each region. “We have to stick to the present system, the regional tripartite board. If Congress would like to consider fixing another minimum wage, it is up to Congress,” Bello said. “We will give our input. We can’t just let Congress decide alone,” he added. Labor Undersecretary Ciriaco Lagunzad III said the regional tripartite board will entertain the new wage petition if there is a “supervening condition.” "So the sequence is if there is a petition, the Board would have to determine if there is sufficient or to be exact if there is a supervening condition to allow them to entertain the petition," Lagunzad said. "If not, then the board will also issue a decision that the finding is that there is no supervening condition. If there is a supervening condition then they will start consultation and analysis and they have a number of days in which to call for a public hearing and a number of days to make a decision after the last public hearing," he added. The law states that a salary adjustment can only be issued once a year. It added that no petition for salary hike may be entertained within the 12-month period from effectivity of the order. But a wage increase within the period is allowed when there is a supervening condition. The regional wage boards will determine supervening conditions such as extraordinary increase in prices of petroleum products and basic goods and services.
