The National Capital Region Police Office (NCRPO) issued a clarification on Wednesday that no police officer in Metro Manila was arrested for indiscriminate firing amid the New Year's Eve revelry.
NCRPO Director Guillermo Eleazar, however, said three cops were apprehended in Metro Manila for illegal discharge of firearms, and disclosed they are all now facing criminal and administrative charges.

Article 254 of Act 3815 or the Revised Penal Code describes illegal discharge of firearm as the act of firing a weapon against another person without the intent to kill. It falls under the category of alarm and scandal. While indiscriminate firing has almost the same description, the NCRPO mostly connects the term to incidents recorded during the New Year's Eve revelry. Eleazar said there were three recorded "isolated" cases of illegal discharge of firearms involving policemen during the holiday season. The first case was recorded on December 20, 2018 when elements of Caloocan City Police arrested PO3 Cesar Tolentino for using his service firearm, a 9mm pistol, along 7th Avenue, Brgy. 56. Caloocan cops also nabbed PO1 Danilo Tiempo, assigned to Navotas City Police Station, on December 24 , 2018 after he allegedly fired at a group of people during a wake. Six persons were injured in the incident and investigators said the motive was revenge since the injured victims allegedly mauled Tiempo's father. The last report was noted in Taguig City on December 26, 2018 when police apprehended PO1 Agustin Cedillo, assigned to Makati City Police Station, after he fired a gun during a commotion with bystanders along Barangay Bagong Tanyag. "These shooting incidents days before the New Year's eve were criminal in nature and not gestures or displays of revelry or celebrating the season. They were immediately investigated and all three policemen have been administratively and criminally charged," Eleazar said. Earlier, the PNP released an initial assessment which showed that 24 individuals, including seven cops, were arrested nationwide from December 16, 2018 to noon of January 1, 2018 for indiscriminate firing. Three of the seven cops were said to be nabbed in Metro Manila by the NCRPO. In a television interview Wednesday, Chief Supt. Benigno Durana Jr., PNP spokesperson, said that further investigation showed not all of the seven cops were guilty of indiscriminate firing. "Based on our succeeding investigation, not all of them are related to the New Year's Eve revelry especially those in Metro Manila," Durana explained. Just the same, Durana vowed that the cops who defied PNP chief, Director General Oscar Albayalde's order to refrain from firing their guns during the holiday season would face appropriate sanctions after undergoing due process. "There will be no mercy if we found out after due process that, indeed, they fired their guns," he said.
