CALAPAN CITY, Oriental Mindoro — The Regional Trial Court (RTC) here has cited for indirect contempt the general manager and counsel of the local electric cooperative for disobeying its earlier order affirming the directive of the National Electrification Administration (NEA) to install a new cooperative manager.
In a two-page order dated Oct. 15, 2018, Judge Erwin Y. Dimayacyac of the RTC Branch 42 in Pinamalayan ordered incumbent manager of the Oriental Mindoro Electric Cooperative (ORMECO), Patrocinio M. Panagsagan, to obey the four board resolutions acknowledging and accepting the appointment of Orlando M. Andres as the new NEA-appointed manager.
On Oct. 1, 2018, the court lifted the preliminary injunction and status quo ante order which earlier prevented Andres to assume the post.
The four board resolutions contain the acceptance of the ORMECO officers of the NEA appointment of Andres which was made pursuant to its supervisory authority over all electric cooperatives in the country.
The court also found Lawyer Gregorio Bobos II, ORMECO’s counsel, guilty of indirect contempt for giving wrong information to the public which the court said was an improper conduct that tends to degrade the administration of justice.
Both Panagsagan and Bobos, including security guard Celso Apicimado, were reprimanded by the court.
“Philippine National Police Provincial Director Senior Superintendent Tomas R. Frias is hereby directed to assist the proper government agency for proper implementation of the order of this court and effectivity of ORMECO Inc. board resolutions nos. 17-137, 17-138, 17-142 and 17-151. The Resolution of this court dated October 1, 2018 is immediately executory,” said Dimayacyac in his order.
