Sandigan dismisses criminal liabilities of late ex-Samar Gov. Milagros Tan
Enforcing a 2021 Supreme Court (SC) decision, the Sandiganbayan has ordered the dismissal of the criminal liabilities of former Samar governor Milagros T. Tan on account of her death.
"Wherefore, let this case be dismissed with respect to accused Milagrosa Tee Tan and let the Bureau of Immigration be furnished a copy of this resolution," the Sandiganbayan said in a resolution issued last Feb. 8.
On March 1, 2019, Tan and several other accused were convicted of graft. The late former governor was sentenced to a total of 62 to 115 years of imprisonment. The conviction was appealed by Tan and those convicted before the SC.
On Nov. 28, 2021, the SC, while affirming the Sandiganbayan’s decision, ruled that “the cases against accused-appellant Milagros Tee Tan are dismissed by reason of her death.” The SC had declared its ruling final and executory.
The charges against Tan arose from the purchases of “emergency supplies” worth P16.1 million without public bidding at the height of typhoon “Kidang” in 2001.
Tan’s other cases involving alleged irregular purchases of drugs and medicines in 2009 had earlier been dismissed by the Sandiganbayan.
