Magsino bill strengthens rights of cohabiting same-sex couples on property issues

OFW Party List Rep. Marissa "Del Mar" Magsino is batting for the establishment of a comprehensive property regime for cohabiting same-sex partners in the Philippines. 

Magsino filed for this purpose House Bill (HB) No.10206, or An Act Instituting A Property Regime for Cohabiting Same-Sex Partners and for Other Purposes. 

The measure aims to recognize and safeguard the rights of cohabiting same-sex couples in property acquisition, ownership, and disposition.

“Though through the years there has been change in the mindset of people on long-standing stereotypes and generalizations with social perceptions becoming more accommodating of the LGBTQ+ community, there’s still no legislation that guarantees equal rights for everybody regardless of sexual orientation or gender identity,” Magsino said in a statement Tuesday, April 2.

Also known as the Same-Sex Partners Property Relations Act, HB No.10206 intends to provide legal clarity and protection for individuals in same-sex partnerships that are cohabiting or living together. 

It covers the acquisition, ownership, enjoyment, distribution, and disposition of both real and personal property acquired during the partnership.

Additionally, under the bill, partners in a same-sex relationship will have joint rights to administer and enjoy co-owned properties. In cases of incapacity or inability to administer properties, provisions are made for the other partner to assume management responsibilities until the situation is resolved.

The measure also addresses issues such as financial obligations, gifts, loans, and the dissolution of the partnership, ensuring equitable treatment and fair distribution of assets upon termination. 

Magsino's bill seeks to ensure equitable treatment and fair distribution of assets in the event of termination. 

It establishes clear guidelines and procedures for handling financial matters, such as specifying the responsibilities of each partner regarding debts and obligations incurred during the partnership.

“I strongly believe that the passage of this bill is crucial in granting legal recognition and safeguarding the rights of same-sex couples. By enacting the Same-Sex Partners Property Relations Act, we affirm their inherent right to property ownership and management," the minority solon said. 

"This legislation is a significant step towards achieving greater equality and justice for all Filipino citizens, regardless of their sexual orientation or gender identity. It is imperative that we ensure equal protection under the law for every individual in our society," she added.
