Valenzuela City gov’t regulates vape products


Valenzuela City Mayor Wes Gatchalian has signed an ordinance regulating the use of vape products in the city for the health and safety of residents.

Under Ordinance No. 1098, Series of 2023 or the Non-Combustible Nicotine and Non-Nicotine Delivery Systems Regulations, the purchase, sale, and use of vaporized nicotine and non-nicotine products or novel tobacco products is only for people ages 18 and older. It was implemented in the city on Saturday, June 17.

The city government said that all retailers of the vape products must ensure that their customer is not a minor, while buyers must present a valid government-issued photo ID proof of age or birthday.

Sellers who are registered with the Department of Trade and Industry or the Securities and Exchange Commission can sell products online but they still need to make sure through the online platform that only customer are 18 years old or older.

The sellers are also prohibited to sell, promote or advertise, and conduct demonstrations within one hundred meters from school perimeter points, learning facilities and institutions, playgrounds or other places frequented by minors.

The ordinance requires that establishments who sell non-nicotine products must post clear signage stating the following: “The sale or distribution of Vaporized Nicotine and Non-Nicotine Products to or by persons below eighteen (18) years old is illegal. These products are harmful and contain nicotine which is a highly addictive substance. It is not recommended for use by nonsmokers.”

It also states that using vaporized nicotine and non-nicotine products are prohibited in school facilities or institutions, elevators and stairwells, places with fire hazards such as gas stations and other flammable liquid and combustible materials, public places such as hospitals and other medical institutions, churches, transportation, conference halls, and other public places.

The local government reminded all the manufacturers, importers, sellers, retailers and distributors to register in the Department of Trade and Industry (DTI).

Only businesses that comply with the product standard and registration requirements stated in this ordinance will be granted a business permit and permission to sell vape products.

Businesses that violate the ordinance will be subject to appropriate administrative penalties. First time violators will be fined P20,000,

The fine for those who will be caught for the second time is P30,000, while third-time violators will have to pay P50,000. (Hannah Nicol)
