DOLE issues pay rules for 2024 holidays


The Department of Labor and Employment (DOLE) has issued an advisory specifying the wage computations for regular holidays and special non-working holidays for 2024.

DOLE Secretary Bienvenido Laguesma  said the move is to remind all private sector employers to ensure the proper payment of wages in accordance with the guidelines set out in Labor Advisory No. 27, Series of 2023.

He said employees who would report to work during regular holidays should be paid a total of 200 percent of their wages for the first eight hours.

For employees’ overtime work, they should be paid an additional 30 percent of their hourly rate on the said day, on top of the 200 percent.

Employees who report to work on a regular holiday that also falls on the rest day should be paid an additional 30 percent on top of the 200 percent wage. An additional 30 percent of the hourly rate shall also be paid when working overtime.

Meanwhile, employees who will not work should still be paid 100 percent of their wage for that day, subject to certain requirements under the implementing rules and regulations of the Labor Code, as amended.

For special non-working days, the “no work, no pay” principle shall be observed, unless there exists a favorable company policy, practice, or collective bargaining agreement (CBA) allowing payment on a special day.

For employees who will work, they are entitled to an additional 30 percent of the basic wage for the initial eight hours of work. Overtime work on these days warrants an extra 30 percent of the hourly rate.

If employees work on a special day that coincides with their rest day, they are entitled to an extra 50 percent of their basic wage for the first eight hours worked, with an additional 30 percent of their hourly rate for overtime work.

The regular holidays are New Year's Day (Jan. 1), Maundy Thursday (March 28), Good Friday (March 29), Araw ng Kagitingan (April 9), Labor Day (May 1), Independence Day (June 12), National Heroes Day (Aug. 26), Bonifacio Day (Nov. 30), Christmas Day (Dec. 25), Rizal Day (Dec. 30), Eidul al-Fitr (to be proclaimed), and Eidul al-Adha (to be proclaimed).

Meanwhile, the special (non-working) days are Chinese New Year (Feb. 10), Black Saturday (March 30), Ninoy Aquino Day (Aug. 21), All Saints' Day (Nov. 1), All Souls' Day (Nov. 2), Feast of the Immaculate Conception of Mary (Dec. 8), Christmas Eve (Dec. 24), and Last Day of the Year (Dec. 31).
