Observe holiday pay rules for National Heroes' Day – DOLE


Employees who reported for work on Monday, Aug. 29, will get twice their regular pay as the country celebrated National Heroes' Day.

The Department of Labor and Employment (DOLE) issued Labor Advisory (LA) No. 16 series of 2022 to remind employers of the pay rules which will be in effect during the day, which former president Rodrigo R. Duterte declared a regular holiday through Proclamation No. 1236.

The event aims to commemorate the contribution of the country’s heroes to nation-building.

According to Labor Secretary Bienvenido E. Laguesma, during a regular holiday, employees who work overtime will get another 30 percent of their hourly rate.

If the holiday coincides with their rest day, they will get an additional 30 percent of their holiday pay.

However, if they opt to spend the day on vacation from their work, they will still be entitled to 100 percent of their regular pay that day.

“For work done in excess of eight hours during a regular holiday that also falls on his/her rest day, he/she shall be paid an additional 30% of his her hourly rate on said day (Hourly rate of the basic wage x 200 % x 130% x 130% x number of hours worked),” the LA No. 16-22 reads, signed by Laguesma on August 22.

Laguesma, however, warned erring employers to face consequences and shall not escape the long arm of the law if they refuse to pay the necessary wage during the holidays.
