GSIS reclaims property in Pasay after 12 years

The state-run Government Service Insurance System (GSIS) has regained possession of its property in Pasay City after 12 years of dispute with popular Chinese food chain Gloria Maris Shark’s Fin Restaurant.

The restaurant, according to GSIS, was evicted from the GSIS property after years of “refusing to turn the property over” notwithstanding orders from the Regional Trial Court, Court of Appeals, and the Supreme Court.

“After 12 years, the law has finally allowed us to recover the GSIS property through due process and we are now free to utilize the property for the interest of our members and pensioners,” said GSIS President and General Manager Wick Veloso in a press statement on Friday, Sept. 16.

Held from Sept. 12 to Sept. 14, the eviction process, warranted by a writ of execution, was described to be “orderly and peaceful.”

While the state-run pension fund institution did have a lease contract with the restaurant, it only covered the period from Jan. 1, 2006 until Dec. 31, 2007. The GSIS, however, allowed the restaurant to continue using the property through a monthly lease from 2007 until June 2010.

The food chain, following the termination of the monthly lease scheme, “refused to surrender” the property to GSIS. This, according to Veloso, was when they filed an ejectment case against the food chain.
