DOLE releases pay rules for Ninoy Aquino, National Heroes days


The Department of Labor and Employment (DOLE) has reminded employers and business owners to observe proper pay rules to their workers for Aug. 21 and Aug. 29.

Aug. 21 was declared as a special non-working holiday in observation of the 39th death anniversary of the late Senator Benigno “Ninoy” Aquino Jr. while Aug. 29 is a regular holiday in celebration of the National Heroes Day.

In an advisory released on Monday, Aug. 22, DOLE said proper payment of extra wages should be done for workers who reported on Aug. 21, which falls on Sunday.

Pursuant to Proclamation No. 1236 issued by President Duterte in 2021, the policy of "no work, no pay" shall apply unless there is a company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.

“Work performed on a special non-working holiday merits additional compensation of at least 30% of the basic wage or a total of 130%,” the advisory says.
