A Taguig court has confirmed that it has received the adultery cases filed against TV personality Maggie Wilson and Tim Connor.
The Taguig Metropolitan Trial Court (MeTC) Branch 116 confirmed to Manila Bulletin that it received two information filed by the Office of the City Prosecutor of Taguig.
Businessman Victor Consunji, the estranged husband of Wilson, filed three complaints with the prosecutor’s office charging her and Connor of having sexual relations in December 2021, January 2022 and February 2022.
The blog Fashion Pulis published copies of the cases filed with the Taguig Metropolitan Trial Court Branches 115 and 116.
In MeTC Branch 116, Wilson (real name Margaret Wilson) and Connor (real name Tim Jayankura Na Ayudha) have been charged with committing adultery, which is a violation of Article 333 of the Revised Penal Code.
All the three cases were filed by Taguig Assistant City Prosecutor David Michael Go who found probable cause for the crime.
“This is to certify that a preliminary investigation has been conducted in this case; that the complainant was examined, and that the accused was informed of the complaint and of the evidence submitted against him: that he was given a chance to submit controverting evidence; that based on the evidence presented, there is reasonable ground to believe that the crime has been committed and that the accused is probably guilty thereof. This Information is filed with the authority of the City Prosecutor,” according to the case filed with the courts.
The MeTC Branch 116 is handling two of the three adultery cases.
Under Criminal Case 22-34975, received by the Taguig MeTC Office of the Clerk of Court on July 8, Wilson and Connor are accused of adultery.
In charging Wilson and Connor, the prosecutor’s office stated “that on or about the month of December 2021, more or less, in the City of Taguig Philippines and within the jurisdiction of this Honorable Court, the above-named accused, as a group and in conspiracy with each other, did, then and there, willfully, unlawfully, knowingly, and feloniously commit the crime of Adultery by, then and there, having sexual intercourse with each other despite the fact that Accused Wilson is a married woman who is married to Private Complainant Victor Sid B. Consunji, and while Accused Ayudha, who is not the husband of Accused Wilson, had carnal knowledge of the latter, despite knowing her to be married to the Private Complainant, much to the latter's damage and prejudice. in violation of the above-cited law.”
Under the Revised Penal Code, “Adultery is committed by any married woman who shall have sexual intercourse with a man not her husband and by the man who has carnal knowledge of her knowing her to be married, even if the marriage be subsequently declared void. Adultery shall be punished by prision correccional in its medium and maximum periods.”
“If the person guilty of adultery committed this offense while being abandoned without justification by the offended spouse, the penalty next lower in degree than that provided in the next preceding paragraph shall be imposed,” it added.
In an Instagram story, Wilson quoted the Philippine Commission on Women about adultery and concubinage.
“According to Gabriela Women's Party's bill, adultery and concubinage are often resorted to only as "bargaining suits” to get the other party in a nullity petition to “cooperate" or to capitulate in support negotiations. These suits, while pursued in the initial stages, are often withdrawn or dismissed,” according to Wilson’s post.
It added, “Worse, separated or abandoned wives, who have no legal remedy in the absence of a divorce law, are always under a constant threat of suit from their estranged husbands. They are blackmailed by their estranged husbands through adultery, and while they also have a ground to file concubinage, they face the difficulty of proving the crime due to the inherent difficulty in the standards set by the law. In many cases, women who are faced by these threats are forced to forego legitimate custodial claims of their children while some are forced to give up their claims over conjugal properties, assets and the like.”
Connor, in an Instagram Story, stated, “For everyone looking for a reaction or an interview from me...You won't get one.”
“I don't stoop so low as to answer complete and utter rubbish accusations out of anger that hold no water. (Unless I am required to do so by law enforcement of that country),” he said.
He added, “I hope for their Son Connor's sake, all issues between Victor & Maggie get resolved peacefully as soon as possible. This is not a circus; this is people's family lives-please respect that.”
Recently, Wilson took to Instagram to complain that representatives from Victor Consunji Development Corp. and Barangay Bambang in Taguig illegally entered her home in Acacia Estate.
Her lawyers vowed to “hold liable to the fullest extent of the law all those involved in this dastardly act.”
