Mandaluyong hit-and-run suspect submits counter affidavit; victim skips hearing


The suspect in the hit-and-run of a security guard in Mandaluyong City last June 5 submitted his counter affidavit on Thursday, June 23, at the Mandaluyong City Prosecutor's Office during the second day of preliminary investigation.

Jose Antonio Sanvicente, the owner and driver of the white Toyota Rav-4 who hit and ran over security guard Christian Floralde, was accompanied by his lawyer Atty. Danny Macalino as he submitted his counter affidavit.

Sanvicente, who initially skipped the first day of the preliminary investigation on June 17, was asked about his counter affidavit but did not give an answer. He and his lawyer left immediately after filing the documents.

Meanwhile, Floralde's lawyer, Atty. Federico Biolena, said that his client did not attend the second day of the hearing because his client is still recovering from the injuries he sustained from the incident.

Floralde attended the hearing on June 17 and gave his sworn statement to the Prosecutor's Office.

On June 7, the Mandaluyong City police filed frustrated murder and abandonment of one’s own victim charges against San Vicente at the Mandaluyong City Prosecutor’s Office.

Obstruction of justice charges were also filed on June 8 by the Mandaluyong City police against three security personnel of the subdivision where Sanvicente lives for barring the police from entering his home.

Floralde said on June 10 that he will pursue a case against Sanvicente following his discharge from the VRP Medical Center.

Sanvicente finally surrendered to the PNP and appeared at a press briefing in Camp Crame, Quezon City.

Accompanied by his lawyer and parents, Sanvicente apologized to Floralde and his family for the incident. His SUV was also turned over to the police.
