This was according to Comelec Commissioner George Garcia. In a television interview on GMA's Unang Balita Garcia was asked if there will be issues in technicality regarding this move by Lacson.

"As far as the Comelec is concerned, ang nabanggit po ninyong kandidato ay kandidato pa rin ng partido politikal at the time na siya ang nag-file ng candidacy (the candidate you mentioned is still a candidate of the political party at the time that he filed for candidacy)," he said.

Garcia said that whatever that political party indicated in his Certificate of Candidacy (COC) as well as the attached Certificate of Nomination and Acceptance (CONA) is the one still being acknowledged by the poll body.

"As far as the Comelec is concerned, per our rules per existing law, siya ay kandidato pa rin nuong partido na ginamit niya nuong siya ay magfile ng kandidatura (he is still a candidate of the party which he used when he filed for candidacy)," he added.

After resigning from Partido Reporma, Lacson stated that he will be running as an independent candidate.
