BIR allows filing of amended 2021 ITR without penalties

The Bureau of Internal Revenue (BIR) is allowing taxpayers to submit corrected 2021 corrected income tax return (ITR) filed on April 18 and prior dates without penalties.

BIR Commissioner Caesar R.Dulay said in Revenue Memorandum Circular 42-2022 that lenient policy was adopted due to difficulties in beating the deadline caused by long Lenten Holiday and the challenges of Covid-19.

The deadline for the filing of 2021 corrected ITR is on May 16, 2022.

The BIR chief explained that if the amended return results in over payment of taxes the said taxpayer may apply for a tax refund.

He also said the excess payment maybe used against the tax due for the same tax type in the succeeding period.

In the same memorandum, Dulay asked taxpayers filing "no payment" return to submit them electronically using the eBIRForms, or face penalties for wrong venue filing.

He said, however, that senior citizens and person with disabilities may still file their ITR manually to the revenue district office near their residence, or place or work.
