Foreign workers seeking to renew their Alien Employment Permit may do so after the lifting of the Enhanced Community Quarantine (ECQ) or General Community Quarantine (GCQ).
In Labor Advisory No. 16-2020, the Department of Labor and Employment said AEPs due for renewal during the implementation of the ECQ and GCQ can be filed within 45 working days after the lifting, “without penalty.”
An AEP is one of the requirements for the issuance of a work visa to foreigners who intend to engage in gainful employment in the Philippines.
An AEP is issued once it is ascertained that a foreign worker will be performing a job that local workers are not capable of doing.
“The DOLE Regional Office may issue their own internal guidelines with regard to the acceptance of applications for new and renewal of permits,” read the advisory.
Although the Labor Department said online application is highly encouraged.
“Otherwise, the social distancing requirement, and health and safety measures, shall be observed strictly in the filing of applications for permits and licenses and issuance,” said DOLE.
As to the publication and posting of new AEP applications, the Labor department said this may be undertaken primarily in the official DOLE website of the concerned Regional Office and/or Public Employment Service Office (PESO), and is temporarily allowed in regions where publishers of newspaper of general circulation are not yet allowed to operate.
“However, upon resumption of operations, publication in newspapers of general circulation shall be conducted in full compliance with the requirement of the labor market test,” said DOLE.
The publication requirement provides the public 30 days from the time of publication to object to the new foreign employee.
