The camp of Senator Antonio Trillanes IV will seek the dismissal of the libel charges filed against him in Davao City for lack of jurisdiction.
Attorney Reynaldo Robles, Trillanes’ legal counsel, questioned on Wednesday the authority of the Davao City Prosecutor’s Office to try the libel complaint by former Davao City Vice Mayor Paolo Duterte and his brother-in-law Manases Carpio for the statements made by the opposition lawmaker in an interview over a Cebu City-based radio station.
“Bakit ho sa Davao naka-file ‘yong kaso? All of the allegations of the complaint we just received, ang elements nangyari sa Cebu. Pati mga testigo sa Cebu. Sa tingin ho namin walang hurisdiksyon ‘yong piskalya ng Davao. And we will file the appropriate motions at the appropriate time, (Why was the case filed in Davao? All of the allegations of the complaint we just received, its elements happened in Cebu. Even the witnesses were in Cebu. We think that the Davao prosecutor has no jurisdiction over this. And we will file the appropriate motions at the appropriate time),” Robles told reporters in a briefing in Senate Wednesday afternoon.
When asked about the specific move, Robles said, “[We will file a motion] To dismiss the case because the Davao prosecutor has no jurisdiction over an offense which happened in Cebu.”
The lawyer, on the other hand, maintained that they will comply with the subpoena issued by the Davao Prosecutor’s Office for Trillanes’ counter-affidavit within 10 days.
