She was accused of violating Section 3(g) of R.A. 3019 or the Anti-Graft and Corrupt Practices Act in the charge sheet filed by Assistant Special Prosecutor III Jorge B. Espinal.

On April 12, 2013, Simacio reportedly gave unwarranted benefits to A.S.O. Construction when the municipality entered into the "Contract Agreement for the Construction of Anda Multi-Purpose Building/Center" in the amount of P2,498,923.50.

However, the contract price was 57.58 percent above the Commission on Audit (COA) cost evaluation of P1,744,406.14, or an overpriced cost of P754,517.36 due to higher labor costs than the normal.

At the same time, the normal and usual price in the construction industry was pegged higher in the contract and there was also an overestimated quantity of reinforcing steel bars, among many other things.

Her bail bond has been set at P30,000.
