In the charge sheet filed by graft investigation and prosecution officer Eric Anthony Dumpilo, Tamayo was accused of violating Section 3(e) of Republic Act 3019, otherwise known as the Anti-Graft and Corrupt Practices Act.

He allegedly caused undue injury to the PCG when he awarded the amount of P9,585,016 to Joshwell Trading by approving Disbursement Voucher (DV) No. 09-03-0852 dated March 25, 2009.

This was for the full payment of all the SMART items, which were supposed to be delivered on November 7, 2008.

However, Joshwell Trading only made a partial delivery of the SMART items, as indicated in the inspection and acceptance report attached to the DV.

His bail bond has been set at P30,000.
