Early resolution of Kian killing court case seen

The trial for murder and planting of evidence cases against the three former Caloocan police officer accused of killing 17-year-old Kian Loyd Delos Santos may be resolved this year as the accused are now set to take the witness stand.

This was said by Caloocan City Regional Trial Court Branch 126 Judge Rodolfo Azucena Jr. in an open court during the recent trial.

On Thursday, Azucena denied a bid by the defense to avoid presenting its own evidence.

“The motion for leave is denied, the prosecution has presented sufficient evidence,” Azucena said.

This was after defense lawyer Oliver Yuan manifested to file a demurrer of evidence as the prosecution already wrapped up its presentation of evidence.

Demurrer of evidence is a motion to dismiss the case based on the prosecution’s insufficient evidence. Before a demurrer can be filed, the court must first approve a motion for leave.

This only means that the accused — PO3 Arnel Oares, PO1 Jeremias Pereda and PO1 Jerwin Cruz are set to take the witness stand after the court denied their motion for leave.

The former cops will have to answer to several eyewitness testimonies and other evidence presented by the prosecution.

Oares will be the first one to take the witness stand on August 6.

Meanwhile, parents of Kian who also attended the trial are hoping that the three accused will be convicted and justice will be served.

Kian Loyd Delos Santos, a Grade 12 student, died at the hands of the policemen after he allegedly resisted arrest during an anti-illegal drug operation on the evening of August 16, 2017, in his neighborhood in Barangay 160, Libis Baesa.

However, witnesses and a CCTV footage disputed the cops’ stories.

It can be recalled that Delos Santos along with other teenagers’ death sparked public outrage over the government’s war on drugs.
