By Leslie Ann Aquino The Department of Labor and Employment (DOLE) has added another requirement for foreign workers applying for the Alien Employment Permit (AEP) during the modified enhanced and general community quarantine periods. In Labor Advisory No. 19-2020, the DOLE said applicants are now required to present a clearance issued by the Philippine Amusement and Gaming Corporation (PAGCOR) to the Philippine offshore gaming operators (POGOs) set to hire the foreign applicant. "For POGOs and related establishments, in addition to the documentary requirements for the issuance of AEPs, the applicant shall also submit copy of recent PAGCOR Authorization to Operate, as proof that the POGO establishment is authorized to resume operations," read the advisory. To note, not all industries are already allowed to resume their operations in areas under the Modified Enhanced Community Quarantine (MECQ) and General Community Quarantine (GCQ). The Labor department said their Regional Offices may also issue their own internal guidelines with regard to the mode of accepting AEP applications and release of AEP cards. "DOLE-ROs may utilize their existing online system or may accept applications via email," the advisory read. "For the issuance and release of AEP cards, use of courier services to deliver the AEP cards is highly encouraged at the expense of the applicants or their employers, otherwise, the social distancing requirement and safety measures shall be strictly observed," it further read. DOLE usually requires AEP applicants to submit their duly accomplished application form; photocopy of passport of Foreign National (FN) with valid visa; original copy of Notarized Contract of Employment/Appointment or Board Secretary’s Certificate of Election enumerating the duties and responsibilities, annual salary, and other benefits of FN; 2 pieces 2×2 ID picture with white background; proof of Taxpayer’s Identification Number (TIN); and authorization letter from the company or foreign national and photocopy of their IDs. An AEP is one of the requirements for the issuance of a work visa to foreigners, who intend to engage in gainful employment in the Philippines. An AEP is issued once it is ascertained that a foreign worker will be performing a job that local workers are not capable of doing.
